Communiqué on Administrative Fines to be Imposed in 2023 Pursuant to the Electricity Market Law has been Published
 
The Communiqué on Administrative Fines to be Imposed in 2023 Pursuant to the Electricity Market Law ("Communiqué") has been published in the Official Gazette dated December 28, 2022 and numbered 32057.
 
Pursuant to the Communiqué, the administrative fines redetermined for 2023 will be as follows:
 
  • If it is determined that the information requested by the Board is incorrect, incomplete, or misleading, or if no information is provided at all, or if the opportunity for on-site inspection is not provided and upon the situation continues despite a written warning, the administrative fine for 2023 was revised to TRY 3,607,749.
  • If it is discovered that the provisions of this Law, the secondary legislation or the license or the decisions and instructions of the Board are violated and upon the situation continues despite a written warning, the administrative fine for 2023 was revised to TRY 3,607,749.
  • If the violation of the provisions of this Law, the secondary legislation or the license shall be unrecoverable in terms of its nature, the administrative fine for 2023 was revised to TRY 3.607.749.
  • In case of the submission, during the license application process or the license validity period, of false documents and misleading information regarding the conditions for licensing or in the event that the changes in the license conditions affecting the licensing process are not reported to the Board , the administrative fine for 2023 was revised to TRY 5,772,413.
  • In case of any inconsistency with the prohibition of affiliate relation applicable throughout the term of the license and upon the situation continues despite a written warning the administrative fine for 2023 was revised to TRY 6,493,959.
  • If it is determined that the performance of the activity in the market is out of the license scope and upon the situation continues despite a written warning, the administrative fine for 2023 was revised to TRY 7,215,524.
  • If the deficiency is not eliminated within the period given for the elimination of the deficiencies related to the detected unlit, out-of-place luminaires and/or poles, the administrative fine for 2023 was revised to TRY 2,864 for each pole and luminaire.
 
The Communiqué will enter into force on January 1, 2023.
